Parliament extended the possibilities of satisfying claims of power and changed the order of consideration of administrative courts for tax appeals
Parliament adopted in second reading and the Law “On Amending Certain Legislative Acts of Ukraine on improving certain provisions of Administrative Procedure”.
According to the Law of Administrative Court will not consider an appeal of the person who is involved in a case if it is not stated place of residence or location (for legal person) of a person unless it is signed or impossible to establish his authorship, and if it contains a statement that are indicative of contempt of court. The government wants to narrow the range of publishers
In the project propose write in more detail the mechanism of the State Register of publishers, manufacturers and distributors of publishing products and reduce the range of entities publishing to individual entrepreneurs, as well as Ukrainian and foreign legal entities.
Now this activity may be engaged by citizens, foreigners and stateless persons
Government proposes to supplement the output of publications in languages of national minorities of Ukraine (including – in Russian, as stated in the project separately)
It is proposed to establish an exhaustive list of grounds for exclusion from the entity publishing the State Register (they are – grounds for termination of activity in the publishing area) initiative of the owner, the decision of the court, termination of a legal person (termination of the individual-owner).
The Council re-adopted law on simplified tax system with the presidential amendments
November 4, Supreme Council again voted and adopted the law on the simplified system, which amends the Tax Code, relating to the simplified tax system with the presidential remarks. Law “On the court fee” defines the notion of court fee payers and facilities for collecting court fees, the rates, benefits to pay court fees, the order of payment and refund of court fee basis and deferred installment payment of court fees, reducing its size or exemption its payment, send the court fee. The document rates of court fees are established in parts of the minimum wage prescribed by law at 1 January in the year to the percentage of the price action in a fixed amount, taking into account economic changes in the state. MOF: view of the residence does not support the residency of natural persons
The MOF letter of 25.06.2011 № 31-08310-06-29/16281 established the conditions under which an individual is a resident and under which he is a non-resident. In particular, this is a response to a question about the residency of a person if it has a permanent residence permission of Ukraine.
As the Ministry stated, according to the Law “On Immigration” kind of permanent residence in Ukraine is the only permanent residence in Ukraine and do not support the stay (residence) of the foreigner in Ukraine, and therefore can not be a document that certifies the resident status of the taxpayer of Ukraine.
