A Supreme Court holiday bench on Monday called jailed mobster Lawrence Bishnoi’s denial of legal representation in the Sidhu Moosewala murder case unwarranted and said he could go to the Punjab High Court and of Haryana to get a legal aid lawyer.
The bench of Justices Surya Kant and JB Pardiwala made the observation after Bishnoi’s father asked the SC to challenge the orders, including Lawrence’s in-transit order passed by a Delhi court earlier, and a reported that lawyers in Punjab had boycotted his son and were unwilling to represent him.
Barrister Sangram Singh Saron appearing for the petitioner said that they challenged the orders of the Punjab and Haryana High Court as well as the order of a Delhi court granting remand in transit and had approached the Supreme Court because no lawyer for Mansa showed up to provide legal advice to the Respondent.
The SC Bench called the development “absolutely unwarranted” and said the petitioner could contact the HC for legal aid counsel. Legal aid lawyers are obligated by law to help or they could be struck from the panel, the bench said, asking the lawyer to approach Punjab and Haryana HC over the matter.
Regarding Saron’s submissions regarding the challenge to the Delhi Court’s order for the Transit Dismissal on the grounds that “the orders were contrary to certain instructions adopted by the higher court on Bishnoi’s motion”, the SC said that the Punjab police were investigating the case which was at a nascent stage. stage, it would not be appropriate for her to intervene at this stage.
The bench said that since the crime happened in Mansa, Punjab cops were well within their jurisdiction to investigate and could remand Bishnoi in custody.
The bench agreed to hear Bishnoi’s father’s motion on July 11.
