Novant Health’s apology for sacking white executive was ‘absurd’, lawyer said

The lawyer for a white male executive fired by North Carolina-based Novant Health told Fox News the reasons for the dismissal were “absurd” after a federal jury determined the executive was fired because of of his race and sex.

“I think one of the reasons they awarded punitive damages was just that – you just can’t fire people to meet those kinds of demographic goals,” the attorney told Fox News. by David Duvall, Luke Largess. “It’s just outrageous.”

Duvall sued Novant in 2019, arguing the company violated Title VII of the Civil Rights Act by firing him on the basis of his race and gender. Novant said Duvall was fired for poor performance, but a federal jury in Charlotte sided with the former senior vice president and awarded him $ 10 million.

“There was simply no real justification for his dismissal,” Largess told Fox News. “They tried to allay some concerns that he had tripped during a speech two years ago when he was feeling ill and that this embarrassed the company.”

“They said he lacked engagement, but he had some of the highest engagement scores in the business,” the lawyer added. “They said he didn’t engage with his peers, but in his assessment he said it was the thing he did best.”

Duvall was hired in 2013 to lead Novant’s marketing and communications program.

“He rebuilt the team,” Largess said. “Both through written acclimatization and some sort of verbal acclimatization, everyone thought he did a great job.”

“I think the jury was like, ‘You’re kidding,’” Largess added. “These explanations for his dismissal were absurd, and they agreed.”

Novant released a statement Tuesday in response to the jury’s verdict.

“We are extremely disappointed with the verdict as we believe it is not supported by the evidence presented at trial, which includes our reason for Mr. Duvall’s dismissal,” the judge said. declaration noted. “We will pursue all legal options, including the appeal, over the next few weeks and months.”

In 2015, the company’s CEO signed a “health equity pledge” from the American Hospital Association, which elevated the position of head of diversity and inclusion, according to Largess. “The irony is [Duvall] was part of the team – the management team – that oversaw the plan, and he had no idea that they were going to turn around and start firing people just so they could meet their goals, ”said the lawyer to Fox News.

Largess clarified that Duvall supported Novant’s efforts to increase diversity among company executives, but said firing people for the sole purpose of creating diversity amounted to discrimination.
